These Terms & Conditions (“Terms”) govern your use of this website and your purchase of any Heartsong products or services. By accessing the site or placing an order, you agree to these Terms. If you do not agree, please discontinue use of the site. 

1. Use of the Website: 

You agree to use this website only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use of the site. You may not attempt to interfere with the website’s functionality or security. 

2. Orders & Payment: 

All orders must be paid in full at checkout. Prices are listed in USD unless otherwise stated. We reserve the right to update pricing at any time. 

Payment is processed securely through our third‑party payment provider. We do not store your full payment information. 

3. Custom Work & Creative Process: 

Heartsongs and related add‑ons are custom, creative products. By purchasing, you acknowledge that:

• Creative interpretation is part of the process

• You are responsible for providing accurate information during interviews or questionnaires

• Minor artistic variations are normal and expected

We reserve the right to decline projects that violate our content standards (e.g., hateful, abusive, or illegal content).

4. Interviews & Submitted Content: 

If your order includes an interview, you agree that:

• The information you provide may be used solely to create your Heartsong

• You have the right to share any stories, names, or details you provide

• You will not submit content that infringes on another person’s privacy or intellectual property

You retain ownership of your personal story. We retain ownership of the creative work we produce. 

5. Intellectual Property: 

All Heartsongs, recordings, sheet music, and related creative deliverables are original works protected by copyright.

 You receive a personal-use license, which allows you to:

• Download and enjoy your Heartsong

• Share it privately with friends and family

• Play it at personal events

You may not:

• Sell, distribute, or commercially exploit the work

• Claim authorship

• Upload it to commercial streaming platforms

• Use it in advertising or public media without written permission

6. Delivery: 

Digital products are delivered via email or download link. Delivery timelines vary depending on the package selected. 

Rush Turnaround applies only to the base Heartsong package and does not accelerate add‑on deliverables such as sheet music, plaques, or studio vocals. 

Physical items (if applicable) are shipped via standard carriers. Delivery times may vary based on location and carrier performance. 

7. Refunds & Cancellations: 

Because Heartsongs are custom-made, all sales are final once work has begun. 

Refunds may be considered only if:

• Work has not yet started

• A duplicate order was placed by mistake

• A technical error prevented delivery

If you are unhappy with your Heartsong, we offer reasonable revisions within the scope of the original project. 

Add‑On Limitations
Add‑ons are offered based on availability. In periods of high demand, we may decline or postpone certain add‑ons. If an add‑on cannot be completed, you will receive a refund for that add‑on only; the base Heartsong order remains non‑refundable once work has begun.

8. Privacy & Data Protection: 

We collect information at checkout and during interviews solely to fulfill your order.
Your information will never be sold, shared, rented, or made available to third parties, except as required to process your payment or comply with legal obligations.

9. Limitation of Liability: 

To the fullest extent permitted by law, we are not liable for:

• Indirect or consequential damages

• Loss of data

• Delays caused by factors outside our control

• Misuse of your Heartsong or deliverables

Your sole remedy for dissatisfaction is limited to revisions within the project scope. 

10. Changes to These Terms: 

We may update these Terms from time to time. Continued use of the website constitutes acceptance of the updated Terms.
